AFFIDAVIT OF KEYVAN NOURHAGHIGHI

       I,   Keyvan Nourhaghighi, of the City of Toronto, in the Municipality of Metropolitan Toronto, MAKE OATH AND SAY AS FOLLOWING:

1.    I am the Applicant in this motion and I have knowledge of the matter herein deposed to.

2.    I came legally to Canada in July 1990, as a landed immigrant, with my children. My application fully evaluated by the Employment and the Immigration of Canada, when I had permanent resident permit at Germany. In the said application I have given a wide information about myself, and my religion and jobs that I had in Iran as Senior Air Force Officer, and Senior Fighter and Transport Pilot. Exhibit "A" to this my affidavit is a copy of my landed document.

3.     On November 16, 1995, the Crown Prosecutor, Allan Scott, in the hearing of an appeal for a Seat Belt; submitted malicious unfounded allegations against me as I was Iranian and I have seen military training; On January 30, 1996, the same allegation raised against me in an application to the court seeking an order that my property be sell as I was Iranian and I have seen military training. The said application was dismissed with costs by Madam Justice Boland. Exhibit "B" to this my affidavit is endorsement of Madam Justice Boland that clearly stated there was a bold allegation against me; without any support from the community that know me since 1991.

4.   Allan Scott, was defendant in my action for abuse of the court process causing convection against me in absentia in December 16, 1994; causing 7 days imprisonment. Exhibit "C" to this my affidavit is a copy of Judgment of Mr. Judge Knazan, who has heard my grounds for the appeal and declared miscarriage of justice, on November 24, 1995.

5.    On November 23, 1995, before my presentation before His Honour Knazan, Allan Scott prepared condition that I be arrested for malicious allegation of a common assault against a court security officer of November 16, 1995. Exhibit "D" to this my affidavit is Police Supplementary Record of the evidence Crown Witness, Nancy Russell that does not confirm the said allegation.

6.    Since 1995, the aforesaid accusation by a member of the Police, is in front of the court; tens of the proceedings and court appearances, and eight full days trials, on June 12, and December 11, 1996, and January 23, April 1, 2, 3, 9, 17, 1997, are the result of the abuse of the court process. Exhibit "E" to this my affidavit are Reminders of the said proceedings.

7.   On December 11, 1996, I was at Old City Hall, as accused; I was representing myself in the said trial; and I was in the middle of the cross-examination from Marcy Green, who fraudulently was avoiding to give clear answers to my questions during the examinations; Green with different tricks was trying to make me upset and frustrated. I have object her manner as the witness; However, Judge Lampkin, support her and convicted me for contempt of the court, when Green was at witness stand, and was obstructing the justice, by refusing to answer the questions.

8.   As soon as I was sentenced for contempt. Detective, Edward Follert(6840), arrested me by putting a handcuff on my hands in front of the judge; and with Court Security Officers, Dave Aiken( 99491), and two other officers, and two others member the Police, pulled me out of the courtroom; and seizure all my documents and the properties that I had at the courtroom.

9.   Once outside the courtroom, at third floor, Police Office, Scott Stephens, and Court Security Officer, Darryl Morrison, in sudden, attacked to me, and struck my head to the wall, and kept pushing my head and neck to the wall; and than, putting the second handcuff on my hands and tighten them as hard as possible; causing the injuries to nerves of my fingers.

10.   At the same time, Follert, with harassing tone and anger told me: " NOW you are in my house! I was waiting for this moment! I have a lot of plan for you! You can’t survive from my House!" Follert, has brought his face too close to my face and was looking to my eyes directly.

11.   While the Police Officers were pulling sharply my arms upwards; we moved toward the elevator. The Court Reporter, Theresa Morris, was in the Elevator alone; when its door opened. The Officers have ordered to Ms. Morris to leave the Elevator; and she did. Than, they pushed me to the Elevator, and all of them have started punching me on the head, face, neck and all over my body. Follert, was strangling me with all his force. I felt hypoxia. I have lost my voice due to injuries into my throat. On the ground floor, and in the cell, Follert, pulled me by tie so hardly, that my tie and shirt have been torn a part; and my injured neck has suffered more injuries.

12.    At the cell Officers, Stephones and Morrison, again struck my head to the wall and they kept in pressing my head and body, with full strength, to the wall; and hold me for a period of time on the same condition. The said Officers have injured my character by the dirtiest words; and while I was holding pressed to the wall; a shackles was pressed hardly around my ankles.

13.   Than, I was pulled away from the wall. Morrison, started to search me; he pulled a small book out of my jacket, and pushed to my faced and with ridicule asked: " What is this?"  I told him, the book was the Koran, Holy Moslem book. While he was abusive toward my religion and the holy book; he search all pages of the holy book, than that through it on the ground; which was the biggest insult that I have ever was seen in whole my life to a holy book. Morrison, seriously injured my feeling and my faith, on that critical moment that only strength of the faith could help me in front of all the offenders’ wanton and outrageous.

14.    After searching of my upper torso was completed; than everyone stand aside, and in sudden, Morrison, pulled the shackles pushed me with other hand to the ground. At this time, Morrison, whose weight was over 200 pound and more than six feet, sat on my back. I told have him, immediately, that I was suffering neck and back injuries. Morrison, acknowledge my caution; and kept pushing his knees as hard as possible to my spine; deliberating causing the serious injuries to my back, and ribs due to the said torture by Morrison. Exhibit "F" to this my affidavit, is the reports of St. Michael’s Hospital, that indicates injuries on " Rib 8"; at last part of the page.

15.   Than, five other Court Security Officers, came in and pushed me to a cell in the south part; where no one was there. The said five officers pushed me to the ground; and all of them punched on me and kicked me; than all have run away. I was able to read one of the Officer number, " 99086"; he seems to be the acting supervisor at about 5 p.m. on December 11,1996. Officer 99086, refused my request for Emergency treatments at the Hospital.

16.   I was taken from Old City Hall, to Toronto Jail, where the Police interfered with duty of the staff of Toronto Jail; as the result; the said staff have refused to take pictures with a Normal Camera(that I saw there), from my injuries, when I was admitted and I was promised for taking the said photos. Exhibit "G" is the result of my complaint to Ombudsman; where the Toronto Jail alleged at that particular time they where out of any film for Polaroid Camera.

17.   Sudden arrest and detention has caused serious worries for my children; as I am single parent since 1982. As soon as my son got news of my injuries; he has complied against the Officers involved and request medical treatments for me. However, the office of Police complaints commission immediately and maliciously closed my son complain; and asked me to write myself a complaint against officers were involved. Exhibit "H", is my son complaint and the answer of the police complaint commissioner.

18.    At the Toronto Jail, I was mistreated by Dr. Karr, and a staff, Handely. They have refused to take X-rays from my injuries on the same day. And when my son has called 911, and request from them to advise the Toronto Jail; the have taken X-rays; However, never informed me the result that my ribs where broken. Instead of that; they have tried their best to fabricate all kind of documents by their agents at the jail to misrepresent the facts. Exhibit "G" has some of the said evidence at the report of Ombudsman . Exhibit "I", to this my affidavit is reply of Dr. Karr to the College of the Physicians; indicating the injuries that he has exam at Toronto Jail.

19.    I was greatly injured in my reputation in the community, credit, and character, I am feeling my dignity and pride have been severely injured by the Police misconduct. I have suffered emotional and nervous upset. My character and reputation have been injured in eyes of my children, relatives and friends.

20.    In addition thereto, I have been injured through the application of direct force by the Respondents, Follert, Morrison, Scott Stephenes, Dave Aiken; to all part of my head, face, and forehead, neck and shoulders, chest and back, and all part of torso, hands and fingers, all part of legs and ankles, and internal injuries to the nerves and blood vessels of head that makes impossible for few days to lie the head on the pillow; particularly the blood vessels of the throat. The Respondents trespassed whole my body by the harmful and offensive misconduct.

21.    The Respondents, intentionally, have caused me injuries due to the following reasons.I have hired a solicitor and I made contact with several other solicitors to represent me at the criminal proceedings. They have forced the solicitors to not be my representative; therefore I have discharged them; and I represent myself. When they have discovered that I have ability and skill of writing; they have injured my fingers that I could not write. When they saw that I am able to talk strongly against their crimes at the courtroom and in the public; they have injured my throat that I could not talk. And when they have seen that I could remember all the details of their crimes and wrongdoing; they have struck as much as could to my head and banged my head to the wall several times that I suffer head injuries; that they be able to fabricate evidences that I was suffering hysterical and agitating attitude.

22.    On February 25, 1997, I have attended the Police Services Board public meetings for Bill 105;
and while I made my comments for the changes in the Police Services Act; I have brought to attention of the Chief of Police, his staff, and all member of the Board the way that I was tortured by the Police Officers. However, yet the names of all offenders have not been relized. Exhibit "J" to this my affidavit is a copy of my proposal for Bill 105 and a letter from the Board.

23.    On or about December 17, I was charged for assault against Follert and Morrison,  The said officers threats continued in all my attendance at Old City Hall during the trials of the Green, and for set a date for trial new accusations. The Police abusing the process of the court with intention of antagonizing, impoverishing and intimidating me in endless malicious prosecutions based on fabricating evidence by dishonest members of the Police to threaten me for its improper purpose and they own volition for battery. Police was the only witness of the Crown in uncountable malicious prosecutions and Highway traffic malicious charges.  Exhibit " K" indicate 10 charges in two days driving in one week on April 1994.

24.   The Respondents were acting in the course of employment at the time of battery, the Respondent, David Boothby, and the Respondent Metropolitan Toronto Police are liable for battery of me by nine officers. Non of the Respondents, has write any apology to me. I am trying to receive all my personal information including my medical file from Toronto Jail. Exhibit "L", to this affidavit is my letter to Toronto Jail, and the letter of the Ministry of the Solicitor General and Correctional services dated May 26, 1997.

25.     The Chief of Police, David Boothby was responsible for tortious conduct of his officers and disciplinary actions against them. The assault, battery, and torturing a Senior Air Force Officer, graduated from the Academy directly under supervision of Her Majesty The Queen; by several undisciplined Police Constables, who are holding the minimum rank in the Arm Forces, were intended acts to destroy my integrity and dignity and humiliated me in the worse possible way as a Senior Officer, and as a human being, and as a Canadian residents and as a taxpayer to the City of Toronto since 1991; for proper and professional services by the Police. Exhibit "M" to this my affidavit is a copy of taxes that I paid for year 1996 that I tortured.

26.     I feel that all my rights under the charter have been infringed by the Police and its fabricating evidences, and continuous malicious charges against me. Particularly, %99 of all the Police charges after several years trials, were dismissed or has been withdrawn. Exhibit "N" to this my affidavit is several charges that after fifty proceedings withdrawn.

27.     In addition thereto, even when the Police has mislead and obstructed the court, by dishonestly under the oath in the fraudulent presentation of evidences, and has got a conviction against me. The appeal process under the Provincial Offence Act; has granted most of my appeals. However each of said malicious charges has costs me legal expenses to win the case.  Exhibit "O" to this my affidavit, there are statements of the legal fees by three Solicitors: Hy Bergel, Andrew Czernik (RE Exhibit C ) and Lorne Levine.

28.       The appeal process was very expensive for me. Thousands pages of transcripts of the proceedings are the best evidence of the contradictory evidences of the members of the Police in different court about one particular case. Exhibit "P" are tens of the Court Reporters’ receipts.

29.     The Police officers had intentional infection of harmful conduct with me. I have sustained a minor concussion, more than 25 injuries including broken ribs and spines, lacerations and bruises and harm. I became very distress and distraught as the result of willful infliction of nervous shock during torture, and assault and battery. I have lost all my hairs in the face, and part of my head and body due nervous shock; the diseases call Alopecia Areata; Dr. Trinchan, and Dr. Goodman, dermatologists have given treatments that if does not helped.

30.    I have incurred expenses for drugs, transportation, lose income from the management of the investments accounts that I am responsible for them, clothing, personal effects and other relative expenses which full particulars of the accounts will be delivered. Exhibit "Q" is some of my receipts, cashing of the Guaranteed Investment Certificate, and notices for delays payments.

31.    As the result of the post pains of the said battery and tortures I had highest loses at Ontario Courts. I could not perfect files of the appeals and the Registrar dismissed them. I have left the hearing of a motion that I was the moving party, causing about $5000 costs and dismissal of my action. Exhibit "R" to this my affidavit indicate some of the said files.

32.     Several defendants who had knowledge of the said battery and torture , where successful to mislead the court and get the order under section 140 of Court of Justice Act against me; by an unlawful application; where the commencement of the proceeding was require the Consent of the Attorney General be filed with the application. Exhibit "S" to this my affidavit is Table of Contents and affidavit of Hoaken that did not indicate the said Consent.

33. I have prepared this my affidavit to support my claim, not for improper purpose.

SUPPLEMENTARY AFFIDAVIT OF KEYVAN NOURHAGHIGHI

           I,     Keyvan Nourhaghighi, of the City of Toronto, in the Municipality of Metropolitan Toronto, MAKE OATH AND SAY AS FOLLOWING:

1.    I am the Applicant in this Application as such have full knowledge of the matters hereinafter deposed to.

2.    Since March 21, 1997, I am requesting from the Ministry of Solicitor General and Correctional Services to forward the extracts from my Health Care file at Toronto Jail; where after aggravated assault I was hold. However up to this date the said documents was denied; while several correspondence were made between me the said Ministry and the office Information and Privacy Commissioner that I have appeal file of P-9700121, since May 6, 1997. The maximum time for delivery of the said extracts is 30 days according to the law. Exhibit "A" to this my affidavit is letter of the said Commissioner dated July 9, 1997, alleging information was send.

3.   On or about July 16, 1997, I have received extracts from my files in Toronto Jail; However non of my documents at Medial Care file was send to me. Most of the extracts were detective; and some of them contained malicious and wrong information. On December 11, 1996, when I was admitted to the Toronto Jail, a photo was taken from me for the file, that indicate bruising, swelling and abrasions, as Dr. Klar stated on his letter dated February 21st, 1997 and Ms. Mary Elizabeth Nugent reported on her letter dated 19, 1997 [page 30, last paragraph]; that both documents are located at my affidavit sworn on June 9th, 1997, Exhibits "G" and "I". The said defective extracts include the changes in my photo a day after aggravated assault by the Respondents. Exhibit "B" to this my affidavit is my letter dated July 24, 1997 to Information and Privacy Commissioner, and the extract of my file; the photo malisously has been forged.

4.    My injuries due to aggravated assault by the Respondents after seven months become worse by weakness of my immune system. The nervous shock due to strangling by Respondent Follert and torture by Morrison in braking my ribs, has caused lose of hear and mustache. Exhibit "C" to this affidavit my some photos that I have taken from injuries in my throat due to strangling and face- loss of hear- at different times.

5.   Since December 11, 1996, that I was attacked by the Respondents; I am suffering many symptoms of the trauma to the head, such as drowsiness, severe headache, restlessness and lack of consciousness; and most of documents have errors in writing that I could not see them at the time; due to shock and spinal and head injuries. The Respondents interfering with my medical care and Solicitors; therefore, I did not get any result from attendants in numerous medical institutes and hiring lawyers. The agents of the Respondents have furnished my symptoms of the trauma to heads to the Respondents; therefore, the Respondents maliciously trying to collecting fraudulent evidences in opposite to the said symptoms, such as "lack of sleep". The Respondents interfered with CT scan at Mount Sinai Hospital; and I made complaint to Radiologist-in-Chief; However I did not received any reply. I have suffered serious bodily harm by the Respondents; and now I am suffering more pain of despises and insults by physicians and their assistants. I have decided to discontinue contact with medical offices. Exhibit "D" to this my affidavit is a letter dated March 13, 1997 addressed to Mr. Kassel, Radiologist-in-Chief.

6. As the result, I have lost the change of proper presentations in my proceedings in the courts causing all my files were dismissed by the Judges and the Registrar; causing over $50,000 general damages, excluding about $10,000 costs that awarded to the defendants and great amount of general damages due to order of Wilkins J. under section 140 of Court of Justice Act that has been obtained after the head injuries due to aggravated assault; that if I was not attached by the Respondents, there was no way that the defendants could obtain such order with frauds and irregularity against me. Today, I have evidences to lead me to believe that I was victim of conspiracy with different objects; particularly, to stay all my proceedings and trials date that I have obtained with very difficulties. Exhibits "E" to this my affidavit is the Order of Wilkins J. entered March 17th , 1997.
7.   Section 140(2) of the Act require the said application be commenced by the consent of the Attorney General of Ontario. The said solicitors defendants after the commencement of the application RE6938/96 have obtained the consent and they have filed it during the hearing; while the date of consent was initiated with "Se" for September, than was changed to "August".  The names of solicitors defendants were misspelled 1)-TYRRELL, 2)- ROASANNE 3)- GUILETTI,  4)- Gary S. 5)- CZERNIAK. The said consent was not given in the letterhead of the "Minister of the Attorney General for Ontario; the top of document had heading of " Ontario Court(General Division)" the bottom of the document was written " Responsible for Women’s Issues"! I have stated several time to Wilkins J. that the said document was fraudulent and the person who has obtain the said document shall provide affidavit. Borden and Elliot was directly involved in the said frauds and abuse of process. Exhibit "F" to this affidavit is a copy of the Consent; and Endorsement of Wilkins J. that the consent was filed in the proceeding.
8. On or about July 22, 1997, I have received a Notice of Change of Solicitors with a letter signed by Borden and Elliot. On June 9, 1997, I have served the Notice of Application to the Respondent Follert; and than to other respondents. On July 28, 1997, I send a letter by facsimile to the Respondents’ Solicitor, R. W. Traves, that a Notice of Appearance to be serve on me to be entitle to receive further material in respect to application. And as far as the Borden and Elliot was involved in numerous conspiracies against me, and my telephone communication is intercepted; I prohibit the telephone communication. On July 29, 1997, I have received a letter from Borden and Elliot alleging: " According to our file, a Notice of Appearance on behalf of respondents dated June 18, 1997, was duly served upon you and filed." The said letter did not had any prove of the allegations of service of a Notice of Appearance to me. The Respondents’ Solicitors have failed to prove his allegations by sending a copy of the documents as I have demand on letter dated July 29,1997. Exhibit "G" to this my affidavit is my letter to Borden and Elliot dated July 29, 1997.
9. Since August 1991, I am victim of a pattern of assaults and batteries by several members of the Respondents; and according to the law I have brought the misconduct to attention of the Chief of Police by writing complaints. I never knew that my complaints would have adverse effect and the Police Respondents become more aggressive than before and would trespass my property. Even after aggravated assault on December 11, 1996, I was seriously harassed by the Respondents, Follert and Morrison, at Old City Hall in January, February and April 1997. Morrison, several times hustled me at Old City Hall. I am seeking an injunction that the Respondents enter into a recognizance to keep the peace under the Criminal Code of Canada.
